The bill aims to prohibit the sale, distribution, marketing, and possession of psychoactive cannabinoids derived from hemp to individuals under the age of 21. It defines "psychoactive cannabinoids" to include substances such as delta-8-tetrahydrocannabinol and delta-10-tetrahydrocannabinol, and establishes that any psychoactive cannabinoids sold must be located in areas inaccessible to minors. Violations of this law will result in penalties, including Class B misdemeanor charges for sellers and fines ranging from $50 to $400 for minors found in possession of these substances. Additionally, all psychoactive cannabinoids sold must be packaged in child-resistant containers.
The bill also notes that while it may require new or increased local expenditures, it is exempt from further requirements under Section 111.05 of the Alabama Constitution because it establishes a new crime or modifies an existing one. The act will take effect on the first day of the third month following its passage and approval by the Governor.
