This bill, relating to the City of Columbiana in Shelby County, authorizes the City Council of Columbiana to establish and regulate the operation of entertainment districts in the city. The bill allows for the establishment of up to two entertainment districts, which may contain Alcoholic Beverage Control Board licensees. The City Council is given the authority to regulate the hours of operation, revoke the entertainment district designation, and regulate other aspects of the operation of entertainment districts. Retail licensees located in an entertainment district may obtain an entertainment district permit, allowing patrons to exit the premises with open containers of alcoholic beverages within the confines of the entertainment district. However, they may not enter the premises of another licensee with open containers or closed containers of alcoholic beverages acquired elsewhere. The bill also prohibits anyone other than a retail licensee from possessing or bringing in an open or closed container of alcoholic beverages acquired outside of the entertainment district during the hours of operation. The ordinance of the city council will be enforced by the City of Columbiana and will provide penalties for violations.
This bill repeals any laws or parts of laws that conflict with it and will become effective immediately following its passage and approval by the Governor or its otherwise becoming law.
