This bill amends existing laws regarding the regulation and production of industrial hemp in Alaska. Key changes include the introduction of new regulations for the commissioner of natural resources to adopt, which specify approved sources of hemp seed or propagation material, require testing for delta-9-tetrahydrocannabinol concentration, and establish isolation distances for hemp production. The bill also introduces a tiered system for grower categories, including a micro-grower category, and eliminates the need for permits for in-state transportation of industrial hemp between registered parties when accompanied by proper documentation. Additionally, it allows for corrective-action plans for violations and provides a framework for the registration and renewal process for individuals producing industrial hemp.

Furthermore, the bill clarifies that individuals registered to produce industrial hemp may retain and recondition products testing between 0.3% and 1% delta-9-tetrahydrocannabinol, and it establishes a tax exemption for compliant industrial hemp products. It also includes provisions for the reinstatement of registrations that lapsed due to regulatory actions and ensures that no destruction of compliant industrial hemp is required. The effective date for these changes is set for July 1, 2026.
