This bill amends existing laws regarding the liability of electric utilities in Alaska concerning vegetation contact with their facilities and establishes requirements for wildland fire mitigation plans. Under the new section AS 09.65.086, electric utilities are generally not liable for costs, property damage, death, or personal injury resulting from vegetation contact with their electrical service facilities, except in specific circumstances such as when the vegetation is located within the utility's property boundaries or if the utility causes the contact. The bill also clarifies that utilities are not liable for injuries to vegetation when actions are taken in accordance with a wildland fire mitigation plan.

Additionally, the bill introduces a new section AS 42.05.352, mandating electric utilities to adopt and annually update a wildland fire mitigation plan, which must be approved by the Department of Natural Resources. This plan should outline how the utility will manage vegetation to ensure the reliability and safety of electric facilities while preventing wildland fires. It includes specific procedures for inspecting and maintaining high-risk areas, interrupting power transmission during fire risks, and coordinating with local fire response agencies. The provisions of this bill apply to civil lawsuits filed after its effective date, based on actions occurring after that date.
