This bill aims to enhance the rights and protections of minors undergoing evaluation or inpatient treatment at psychiatric hospitals in Alaska. It establishes that minors have the right to confidential communication with their parents or legal guardians for at least one hour each week, unless restricted by law or deemed therapeutically unadvisable by the responsible professional. Additionally, the bill mandates the Department of Health to prepare and publish an annual report detailing the use of seclusion and restraint on minors, findings from hospital inspections, and data on minors in state custody receiving care at psychiatric hospitals.
The legislation also introduces new requirements for inspections of psychiatric hospitals, stipulating that the Department of Health must conduct unannounced inspections at least twice a year for facilities where minors have spent more than three nights. Furthermore, psychiatric hospitals are required to notify the Department of Health and the minor's guardian within one business day of any use of seclusion or restraint, including details about any chemical restraints used. The bill is set to take effect on July 1, 2025.
