Analysis
   This bill advances the People's First Initiative by making substantive and conforming amendments to statutes relating to
   human and sex trafficking and sex offenses. This bill will further strengthen Alaska’s criminal justice system to protect
   victims, hold offenders accountable, and make Alaska safer.
   This bill makes substantive and conforming amendments to statutes relating to sex and human trafficking. The committee
   substitute adopted in the House Judiciary committee amends Alaska Statute (AS) 12.72 to add a new section for Vacation
   of Judgment for certain prostitution convictions if the individual was a victim of sex trafficking at the time of the offense.
   If the conviction is vacated, the Department of Public Safety (DPS) may not release the information as part of a criminal
   history record request in certain purposes. The bill also modifies AS 12.63.100 and the definition of sex offenses requiring
   requiring registration.
   The DPS Division of Statewide Services (SWS) is responsible for maintaining the state's central registry of sex offenders
   under AS 18.65.087. The SWS is also responsible for maintaining the state's central repository of criminal history record
   information and collecting, storing, and releasing criminal justice information under AS 12.62. The bill will impact the
   technical programming the DPS has in place for managing the dissemination of criminal history records under AS
   12.62.160. Programming changes will be needed to restrict dissemination of certain criminal history record information
   when a vacatur of judgment is received.
   All programming changes to the criminal history repository require the use of contractors experienced with mainframe
   systems. The DPS estimates the programming changes will require a total of 300 hours to complete at a rate of $140 per
   hour, based on similar programming changes and current contractor rates, for a one‐time cost of $42,000.
