A BILL
FOR AN ACT ENTITLED
1 "An Act relating to municipal regulation of trapping; and providing for an effective
2 date."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 16.05.930 is amended by adding a new subsection to read:
5 (h) This chapter does not prevent a municipality from regulating the practice
6 of trapping within its boundaries, to the extent authorized under AS 29.35.052.
7 * Sec. 2. AS 29.35 is amended by adding a new section to read:
8 Sec. 29.35.052. Regulation of trapping. (a) A municipality may regulate
9 trapping to protect persons and property within its boundaries and may exempt
10 trappers from municipal trapping ordinances for good cause. Ordinances a
11 municipality may enact under this section include ordinances that impose
12 (1) trap identification requirements;
13 (2) signage or other notice requirements for set or placed traps;
14 (3) restrictions on the use of types of traps likely to cause injury or

1 damage to persons or property, including domestic animals;
2 (4) prohibitions on the setting or placement of traps in areas or
3 locations where they are likely to cause injury or damage to persons or property.
4 (b) This section applies to home rule and general law municipalities.
5 (c) Nothing in this section prohibits the
6 (1) Department of Environmental Conservation from exercising its
7 powers to stop the spread of disease;
8 (2) Department of Fish and Game from exercising its powers to
9 manage the state's fish and wildlife; or
10 (3) Department of Public Safety from exercising its powers to protect
11 public health and safety.
12 (d) In this section, "trapping" has the meaning given in AS 16.05.940.
13 * Sec. 3. This Act takes effect January 1, 2024.
