2023 LEGISLATIVE SESSION
Analysis
This bill would exclude electric‐assisted bicycles that are 750 watts or less power output under selected statutory
definitions of motor vehicles. This bill would prompt department commissioners to evaluate regulation changes
promulgated under appropriate statutes to eliminate electric‐assisted bicycles from certain restrictions.
This bill would possibly conflict with the intent of the Board of Game related to regulations restricting the use of
motorized vehicles in specialized areas, such as Controlled Use Areas under 5 Alaska Administrative Code (AAC) 92.540,
for purposes of taking game. Currently under 5 AAC 92.080, the take of game is prohibited in most circumstances with the
use of a motorized land vehicle. Under 5 AAC 92.990(a)(47), “motorized land vehicle” means a motorized vehicle
operated on land. This bill would allow the use of electric‐assisted bicycles to take game in Controlled Use Areas, other
specialized areas and on federal land where it is currently prohibited.
This bill would possibly be in conflict with Alaska Fish and Game Alaska Statute (AS) 16.05.920, prohibited conduct
generally, which is the statutory authority for 5 AAC 92.080.
On federal land, such as lands of the National Park Service and the United States (U.S.) Fish and Wildlife Service, crimes in
violation of Alaska Fish and Game laws and regulations may also constitute federal crimes.
The Alaska Wildlife Troopers anticipate a zero fiscal impact at this time.
