Analysis
The bill creates a new type of protective order to address workplace violence by adding a new article to Alaska Statute
(AS) 18.65. The bill amends AS 18.65 requiring the Department of Public Safety (DPS) to maintain the workplace violence
protective orders in the central registry of protective orders, and peace officers to take reasonable steps to ensure the
orders are entered into the registry within 24 hours.
The bill amends state law to allow for a Vacation of Judgment in which a person may petition the court to vacate the
judgment for certain prostitution convictions for victims of sex trafficking. If the conviction is vacated, the Department of
Public Safety (DPS) would be prohibited from releasing the conviction information in response to a request for criminal
justice information under AS 12.62.160(b)(6),(8), or (9).
The DPS is responsible for maintaining the state's central registry of protective orders under AS 18.65.540, and the state’s
central repository of criminal history record information under AS 12.62. Both the central registry of protective orders and
the state’s criminal history repository currently reside on a legacy mainframe system which will need to be modified to
meet the requirements outlined in this bill using contractor support.
Based on similar project costs, the department estimates one‐time contractor costs as follows:
Central registry changes (protective orders)
‐‐200 hours at $140 per hour for a total estimate of $28,000
Central repository changes (criminal history records)
‐‐300 hours at $140 per hour for a total estimate of $42,000
