STATE OF ALASKA BILL NO. LL0067
2022 LEGISLATIVE SESSION
Analysis
This legislation enables the Commissioner of the Department of Transportation and Public Facilities to spend from the
Alaska Marine Highway System (AMHS) Fund without further appropriation. It also specifies that the AMHS Fund is
created as a special account outside and separate from the general fund.
Under this legislation, because the fund will not lapse and expenditures from the fund may be made according to statute
and consistent with the program and financial plan prepared under AS 37.07.050 (statute relating to 'management plan'
and performance measures), the legislature must make annual appropriations to capitalize the fund. The legislature may
capitalize the fund with AMHS revenue, appropriations from the general fund, and any permissible federal receipts.
Expenditures from the fund are subject to statutory and fiscal constraints. Permissible expenditures are limited to funding
in support of AMHS operations and are subject to legislative review through the annual budget process. The Office of
Management and Budget and Department of Transportation and Public Facilities will continue to be required to reflect
AMHS operating budget authority in the annual budget submission as AMHS Other (Duplicated).
This legislation also codifies the calendaryear cycle for the AMHS budget.
Passage of this legislation will require an appropriation of AMHS receipts to the newly modified fund to prevent ferry
system revenue from sweeping to the Constitutional Budget Reserve under Alaska Constitution Article IX Section 17(d). In
the SLA2022 operating budget this will require both FY2022 and FY2023 language section appropriations. Estimated
projections of these amounts are reflected on page one of this fiscal note. Outyear AMHS receipts are indeterminate.
FY2022 Supplemental AMHS Fund Capitalization:
The amount of gross revenue of the Alaska Marine Highway System, estimated to be $53,365,100, is appropriated
to the Alaska Marine Highway System Fund (AS 19.65.060(a)) for the year ending June 30th, 2022.
FY2023 AHMS Fund Capitalization:
The amount of gross revenue of the Alaska Marine Highway System, estimated to be $53,314,800, is appropriated
to the Alaska Marine Highway System Fund (AS 19.65.060(a)) for the year ending June 30th, 2023.
