A BILL
FOR AN ACT ENTITLED
1 "An Act relating to the prescription and dispensation of ivermectin."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 08.64.367 is amended by adding new subsections to read:
4 (e) A physician or the chief medical officer may prescribe ivermectin by
5 standing order. A standing order issued under this subsection must
6 (1) be written and signed by a physician licensed under this chapter or
7 by the chief medical officer, as applicable;
8 (2) specify a protocol allowing a pharmacist licensed under AS 08.80
9 to dispense ivermectin under the delegated prescriptive authority of the physician or
10 the chief medical officer; and
11 (3) include a plan for evaluating and treating adverse events.
12 (f) An action may not be brought against a physician or the chief medical
13 officer for damages resulting from the good faith standing order prescription of
14 ivermectin under this (e) of this section.
15 * Sec. 2. AS 08.64.367(d) is amended by adding a new paragraph to read:

1 (3) "chief medical officer" means the chief medical officer of the
2 Department of Health and Social Services.
3 * Sec. 3. AS 08.80 is amended by adding a new section to article 3 to read:
4 Sec. 08.80.337. Standing order for ivermectin. (a) A pharmacist following a
5 standing order issued under AS 08.64.367(e) may dispense ivermectin to a person in
6 this state without a prior prescription.
7 (b) A pharmacist following a standing order under this section may not
8 (1) seek personal financial benefit by participating in an incentive-
9 based program; or
10 (2) accept an inducement that influences or encourages therapeutic or
11 product changes or the ordering of tests or services.
12 (c) A pharmacist shall provide each recipient of ivermectin under this section
13 with a standardized information sheet written in plain language that includes
14 information on the importance of follow-up care and health care referral information.
15 The information sheet may not discourage the recipient from using ivermectin for the
16 treatment of novel coronavirus disease (COVID-19).
17 (d) An action may not be brought against a pharmacist for damages resulting
18 from the good faith dispensation of ivermectin under this section.
