2022 LEGISLATIVE SESSION
Analysis
This bill makes substantive and conforming amendments to statutes relating to sex trafficking, human trafficking, and sex
offenses. The bill also creates a process whereby a person who has been convicted of prostitution can petition to have the
conviction vacated when certain circumstances are met. If the conviction is vacated, the Department of Public Safety (DPS)
may not release that information as part of a criminal history background check for employment purposes.
DPS is responsible for maintaining the states central repository of criminal history record information under AS 12.62.110.
This bill will impact the technical procedures DPS has for managing the dissemination of criminal history records under AS
12.62.160. Programming changes will be needed to limit the display of certain criminal history record information when a
vacatur of judgment is received.
All programming changes to the criminal history repository require the use of contractors experienced with mainframe
systems. Should this bill pass, DPS estimates the programming changes will require a total of 500 hours to complete at a
rate of $140 per hour for a onetime cost of $42,000.
