Analysis
This bill modifies Chugach State Park by removing Lions Club Park, a popular community park in Eagle River and directing
DNR to transfer ownership of Lions Club Park to the Eagle River Lions Club. The Eagle River Lions Club has developed and
operated Lions Club Park under a series of DNR permits since 1964. The bill also modifies the boundary of Chugach State
Park to remove private lands, make technical corrections, and add replacement land to Chugach State Park to satisfy the
states obligations under federal Land and Water Conservation Fund (LWCF) grants.
The bill authorizes the Department of Natural Resources (DNR) to take actions necessary to convey the real property
described in this legislation including platting, replating, surveying, subdividing, and other actions. These actions may
require administrative costs related to surveys and easements required to convey the surface estate of Lions Club Park,
and preparation of conveyance and title documents. These costs would be subsumed by the Division without the need for
additional staff.
The bill also acknowledges that the Division of Mining, Land and Water may accept up to $50,000 cash equivalent in
consideration for the conveyance. This cash equivalent would be deposited into the Land Disposal Income Fund (LDIF) as
compensation to the Department for the conveyance of this land, but also may be used to cover administrative costs
described above related to the conveyance.
This legislation is conditional upon the Department of the Interior (DOI) approving a Land Water Conservation Fund
(LWCF) property conversion by removing the Lions Club Park from the Chugach State Park and adding several parcels of
land described in Section 2. Such approval considers identification of what portions of the park are compatible with LWCF
uses and what lands are required to be appraised under UASFLA (Uniform Appraisal Standards for Federal Land
Acquisitions) standards. The Department proposes to enter into a separate Memorandum of Agreement with the Eagle
River Lions Club that they will be responsible for the costs associated with the necessary appraisals for the LWCF property
conversion as a part of this conveyance and these costs are not part of the cash equivalent consideration up to $50,000.
