A BILL
FOR AN ACT ENTITLED
1 "An Act relating to state requirements concerning federal laws, regulations, and orders
2 requiring COVID-19 vaccination; and providing for an effective date."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 44.99 is amended by adding a new section to article 1 to read:
5 Sec. 44.99.050. State requirements concerning certain federal health laws,
6 regulations, and orders requiring COVID-19 vaccination. (a) An official, agent, or
7 employee of the state, a municipality, or the federal government may not enforce a
8 federal law, regulation, or order that violates the Tenth Amendment to the Constitution
9 of the United States by imposing or threatening to impose a fine or other penalty on
10 (1) an individual who does not receive a novel coronavirus disease
11 (COVID-19) vaccine; or
12 (2) a person who does not require an individual to receive a COVID-19
13 vaccine.
14 (b) The attorney general may defend a resident of the state who is prosecuted

1 by the government of the United States for violation of a federal law, regulation, or
2 order requiring acceptance of a COVID-19 vaccine.
3 (c) The attorney general shall file legal action necessary to prevent the
4 implementation of a federal law, regulation, or order that violates the rights of a
5 resident of the state under (a) of this section.
6 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
