                                        FOR AN ACT ENTITLED
 1   "An Act relating to objections to vaccines."
 2   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
 3     * Section 1. AS 14.07.020 is amended by adding a new subsection to read:
 4                   (d) A minor child whose parent or guardian has submitted a signed statement
 5           to school officials stating their objections on religious, medical, or philosophical
 6           grounds to immunization requirements prescribed under (a)(7) of this section is
 7           exempt from those requirements.
 8     * Sec. 2. AS 14.30.125 is amended by adding a new subsection to read:
 9                   (b) A minor child whose parent or guardian has submitted a signed statement
10           to school officials stating their objections on religious, medical, or philosophical
11           grounds to the immunization requirements under (a) of this section is exempt from
12           those requirements.
13     * Sec. 3. AS 18.15 is amended by adding a new section to read:
14                   Sec. 18.15.357. Vaccine objection. A business, an employer, a state agency, a
15           municipality, the University of Alaska, or a school district may not require an

 1            individual to be vaccinated against a specific disease if the individual objects based on
 2            religious, medical, or philosophical grounds to the administration of the vaccine. In
 3            this section,
 4                            (1) "business" has the meaning given in AS 18.35.399;
 5                            (2) "employer" has the meaning given in AS 18.60.105(a);
 6                            (3) "school district" means a borough school district, a city school
 7            district, a regional educational attendance area, a state boarding school, and the state
 8            centralized correspondence study program;
 9                            (4) "state agency" has the meaning given in AS 40.21.150.
10    * Sec. 4. AS 23.10 is amended by adding new sections to article 7 to read:
11                    Sec. 23.10.445. Vaccine objection. Unless contrary to federal law, an
12            employer may not require an employee or applicant for employment to be vaccinated
13            against a specific disease as a condition of employment if the employee or applicant
14            objects based on religious, medical, or philosophical grounds to the administration of
15            the vaccine.
16                    Sec. 23.10.450. Definitions. In AS 23.10.430 - 23.10.445, "employer" includes
17                            (1) a person who employs one or more other persons;
18                            (2) the state;
19                            (3) the University of Alaska;
20                            (4) the Alaska Railroad; and
21                            (5) political subdivisions of the state.
22    * Sec. 5. AS 23.10.430(c)(2) is repealed.
