A BILL
FOR AN ACT ENTITLED
1 "An Act relating to eliminating vacant positions in the classified and partially exempt
2 service of the state; and providing for an effective date."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 39.25 is amended by adding a new section to read:
5 Sec. 39.25.156. Elimination of vacant positions. On June 30 of each year, the
6 director of personnel shall eliminate a position in the classified or partially exempt
7 service that has been vacant for the immediately preceding 364-day period. For
8 purposes of this section, a position is not vacant if a full-time, part-time, temporary,
9 permanent, or nonpermanent employee
10 (1) is occupying the position;
11 (2) occupied the position at any time during the immediately preceding
12 364-day period;
13 (3) has been hired during the immediately preceding 364-day period to
14 occupy the position, even if the employment begins in the following fiscal year; or

1 (4) may be eligible to return to the position under AS 39.25.158.
2 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
3 read:
4 APPLICABILITY. This Act applies to contracts that take effect after June 30, 2021.
5 * Sec. 3. This Act takes effect July 1, 2021.
