                                          FOR AN ACT ENTITLED
 1   "An Act relating to filling a vacancy in the legislature by appointment."
 2   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
 3     * Section 1. AS 15.40.320 is amended to read:
 4                    Sec. 15.40.320. Condition and time for filling vacancy by appointment.
 5           When a vacancy occurs in the state legislature, the governor, within 30 days, shall
 6           appoint a qualified person to fill the vacancy. However, [IF THE REMAINDER OF
 7           THE TERM OF THE PREDECESSOR IN OFFICE WILL EXPIRE OR IF A
 8           VACANCY IN THE STATE SENATE WILL BE FILLED BY A SPECIAL
 9           ELECTION BEFORE THE LEGISLATURE WILL NEXT MEET, CONVENE, OR
10           RECONVENE,] the governor may not fill the vacancy if
11                            (1) the remainder of the term of the predecessor in office will
12           expire within 30 days after the vacancy occurs; or
13                            (2) a vacancy in the state senate will be filled by a special election
14           before the legislature will next meet, convene, or reconvene.
