A BILL
FOR AN ACT ENTITLED
1 "An Act relating to the public defender agency; relating to speedy trial time limits; and
2 amending Rules 45(b), 45(c)(6), and 45(d)(7), Alaska Rules of Criminal Procedure."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 18.85.020 is amended by adding a new subsection to read:
5 (b) The public defender may create organizational silos to isolate an individual
6 or group from communications and decision-making within the agency to prevent
7 conflicts of interest in cases.
8 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
9 read:
10 DIRECT COURT RULE AMENDMENT. Rule 45(b), Alaska Rules of
11 Criminal Procedure, is amended to read:
12 (b) Speedy Trial Time Limits. A defendant charged with
13 (1) a felony [, A MISDEMEANOR, OR A VIOLATION] shall be tried
14 within 120 days from the time set forth in paragraph (c) of this rule; or

1 (2) a misdemeanor or a violation shall be tried within 70 days from
2 the time set forth in paragraph (c) of this rule.
3 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to
4 read:
5 DIRECT COURT RULE AMENDMENT. Rule 45(c)(6), Alaska Rules of
6 Criminal Procedure, is amended to read:
7 (6) Minor Offenses. In cases involving minor offenses as defined in
8 Minor Offense Rule 2, the defendant must be tried within 70 [120] days from the date
9 the defendant's request for trial is received by the court or the municipality, whichever
10 occurs first.
11 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to
12 read:
13 DIRECT COURT RULE AMENDMENT. Rule 45(d)(7), Alaska Rules of
14 Criminal Procedure, is amended to read:
15 (7) Other periods of delay for good cause upon application of the
16 defendant or the defendant's counsel.
17 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to
18 read:
19 APPLICABILITY. This Act applies to offenses committed on or after the effective
20 date of this Act.
