A BILL
FOR AN ACT ENTITLED
1 "An Act relating to records concerning protective orders; amending Rule 37.8, Alaska
2 Rules of Administration; and providing for an effective date."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section
5 to read:
6 LEGISLATIVE INTENT. It is the intent of the legislature that, to the extent
7 practicable, the Alaska Court System remove from its publicly available website that lists case
8 records the names of petitioners in a proceeding under AS 18.65.850 - 18.65.870 or
9 AS 18.66.100 - 18.66.180 that was brought before the effective date of this Act, to the extent
10 that AS 22.35.030(b), enacted by sec. 2 of this Act, prohibits the names from being published.
11 * Sec. 2. AS 22.35.030 is amended by adding a new subsection to read:
12 (b) The Alaska Court System may not publish the name of a petitioner in a
13 proceeding under AS 18.65.850 - 18.65.870, or AS 18.66.100 - 18.66.180 in a court
14 record on a publicly available website.

3 DIRECT COURT RULE AMENDMENT. Rule 37.8(a), Alaska Rules of
4 Administration is amended to read:
5 (a) Availability. The following case-related information maintained in the
6 court system's electronic case management systems will not be published on the court
7 system's website or otherwise made available to the public in electronic form:
8 (1) addresses, phone numbers, and other contact information for
9 parties, witnesses, and third-party custodians;
10 (2) names, initials, addresses, phone numbers, and other contact and
11 identifying information for victims in criminal cases;
12 (3) social security numbers;
13 (4) driver and vehicle license numbers;
14 (5) account numbers of specific assets, liabilities, accounts, credit
15 cards, and PINs (Personal Identification Numbers);
16 (6) names, addresses, phone numbers, and other contact information
17 for minor children in domestic relations cases, paternity actions, domestic violence
18 cases, emancipation cases, and minor settlements under Civil Rule 90.3;
19 (7) juror information;
20 (8) party names protected under Administrative Rule 40(b) and (c);
21 (9) information that is confidential or sealed in its written form; [AND]
22 (10) attorney and other e-mail addresses used by the court to distribute
23 court orders, notices, judgments, and other documents; and
24 (11) party names protected under AS 22.35.030(b).
25 * Sec. 4. This Act takes effect 120 days after becoming law.
